Terms of service
Clear expectations make better agreements.
These Terms govern access to DwellPact. By creating an account, selecting Continue, or using the service, you agree to these Terms and acknowledge the Privacy Notice.
Agreement, eligibility, and accounts
You must be at least 18 years old, legally able to enter into these Terms, and provide accurate account information. You are responsible for protecting your sign-in method, keeping profile information current, and notifying DwellPact of suspected unauthorized access. You may use only properties, units, payment obligations, contact information, and records you are authorized to manage, view, or pay. Electronic acceptance records may include the document version, account identifier, timestamp, and acceptance method.
Landlord, tenant, and payer responsibilities
DwellPact provides software for organizing rental relationships. DwellPact is not a landlord, tenant, property manager, broker, insurer, attorney, accountant, tax preparer, bank, or party to a lease. Users remain responsible for leases, notices, screening, fair-housing compliance, habitability, repairs, payment obligations, deposits, fee rules, recordkeeping, and compliance with applicable law.
Subscriptions, trial, renewal, and refunds
Tenant accounts are currently offered without a DwellPact subscription charge. Landlords may use Free or purchase Plus monthly or yearly. Checkout displays the selected plan, billing interval, price, taxes, exact end of any offered trial, automatic-renewal terms, and refund rules before purchase. Unless canceled before the displayed trial end, a trial converts to the selected paid plan and the payment method is charged at the interval shown in checkout. Paid subscriptions renew automatically until canceled; yearly plans are charged up front. You may cancel online through the secure billing portal before the next renewal. Cancellation ordinarily takes effect at the end of the current paid period, with Plus access continuing until then. The first paid Plus charge is eligible for a full refund when requested within seven calendar days, and an annual renewal charge is eligible for a full refund when requested within seven calendar days. Other monthly renewals, partial periods, and unused time are not refundable or prorated except for confirmed duplicate or erroneous charges, service-specific commitments we make, non-waivable legal rights, or another exception in the Plus Cancellation and Refund Policy.
Rent payments, payouts, autopay, and returns
Rent checkout is provided through Stripe and a landlord’s connected payout account. The landlord remains the merchant responsible for the rental transaction. DwellPact does not hold rent or security deposits in escrow, determine lawful deductions, calculate statutory interest, or ensure deposit-return deadlines. Autopay must be separately authorized and can be canceled for future charges; the authorization screen and receipt control the permitted amount, timing, payment method, and cancellation cutoff. Canceling does not eliminate bank stop-payment or other consumer rights. A landlord may request an eligible partial or full return to the original payment method, but DwellPact cannot compel a landlord refund. Provider settlement records control if an informational ledger conflicts with actual money movement. Disputes, chargebacks, insufficient balances, provider rules, and applicable law may affect processing.
Electronic records, signatures, and notices
Where an electronic-signature workflow is offered, you must be able to review the exact frozen record and intentionally select the signing action. Electronic consent, document hashes, and audit records support record integrity but do not guarantee enforceability, statutory service, or compliance in every jurisdiction. Uploading, signing, or messaging a document in DwellPact does not by itself prove that a legally required notice was served. Preserve copies and use another lawful delivery or signing method when required.
Email and text invitations
Property invitations are transactional service messages requested by a landlord or authorized property representative. The sender must have an existing rental-related relationship with the recipient and, for text messages, must confirm the recipient agreed to receive the invitation and related service messages at that number. Message frequency varies; message and data rates may apply. Reply STOP to opt out and HELP for help when those options are offered. Consent is not a condition of tenancy or payment. Unwanted or unexpected invitations may be ignored and reported to support.
Records, messages, media, and submitted content
You retain ownership of content you submit and grant DwellPact permission to host, process, reproduce, and display it only as needed to operate, secure, and support the service. You must have authority and any required consent to upload documents, photos, audio, signatures, or information about another person. Do not submit covert or unlawful recordings, unnecessary government identifiers, full payment credentials, medical records, exploitative images, doxxing, threats, discriminatory housing content, unlawful debt-collection content, spam, malware, or material that infringes another person’s rights. Condition records and metadata do not decide liability or guarantee admissibility. Preserve important originals and do not use DwellPact as the only backup.
Customer reviews
If DwellPact invites you to review the service, your review must reflect your genuine experience and must not contain private property details, another person’s information, unlawful content, or misleading claims. The review form explains that submitting authorizes DwellPact to feature the review and selected display name publicly after owner moderation. We may reject or remove a review for authenticity, privacy, safety, relevance, or policy reasons, but we do not promise publication, require a positive rating, or materially change the meaning of a published review. You may withdraw a review by contacting support, after which it will no longer be eligible for public display.
Reports, exports, and AI
Reports and accounting exports are tax-organized recordkeeping drafts that depend on complete and correctly classified data. They are not filed returns or professional accounting work. AI output may be incomplete, outdated, or incorrect. Della, DwellPact’s AI assistant, does not make screening, eligibility, rent-approval, eviction, renewal, access, or other housing decisions and must not be the sole or determinative basis for one. Nothing in DwellPact is legal, tax, accounting, investment, or financial advice. Independently review important decisions, notices, and filings and comply with fair-housing and other applicable law.
Acceptable use
You may not use DwellPact to violate law or another person’s rights; gain unauthorized access; misrepresent identity, authority, consent, payment, condition, compliance review, or counsel involvement; harass, retaliate, threaten, discriminate, impersonate, spam, or collect debts unlawfully; distribute malware; probe security controls; interfere with the service; evade lawful payment obligations; falsify records; or use automated means that unreasonably burden the service.
Third-party services
Authentication, hosting, storage, communications, payment, accounting-export, monitoring, and AI features may depend on third-party services governed by separate terms. DwellPact is not responsible for a third party’s independent service, availability, or decisions. You authorize DwellPact to exchange the information reasonably needed to complete a feature you request.
Service availability and changes
We may update, improve, suspend, or discontinue parts of DwellPact and may limit access to protect the service or users. We do not promise uninterrupted or error-free operation. To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties that cannot legally be disclaimed.
Suspension and termination
You may stop using DwellPact at any time. We may suspend or terminate access for material breach, fraud, security risk, unlawful conduct, nonpayment, or when required by law. Sections that by their nature should survive—including payment obligations, content rights needed for retained records, disclaimers, and limits—continue after termination.
Disclaimers and liability
To the extent permitted by law, DwellPact is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or decisions made from reports, records, or AI output. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded. Jurisdictions differ, and these limitations apply only to the extent enforceable.
Governing law and dispute process
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, except that federal law and any mandatory consumer protection of your home jurisdiction continue to apply. Before filing a claim, the person raising the dispute must send a written notice through the support page or to dwellpact@gmail.com describing the account, facts, requested relief, and contact information. Both sides will try in good faith to resolve the matter informally for 30 days after receipt. This step does not prevent a request for urgent injunctive relief or a timely eligible small-claims filing. If the dispute remains unresolved, the parties consent to exclusive jurisdiction and venue in the state courts located in Cook County, Illinois, or the United States District Court for the Northern District of Illinois, unless non-waivable law permits the consumer to proceed in another forum. These Terms do not require private arbitration and do not waive any right to a jury trial or class procedure that applicable law otherwise provides.
Changes and contact
We may update these Terms as the service or law changes. The updated date will appear here, and material changes may also be communicated in the service and may require renewed consent. Questions, legal notices, abuse reports, and copyright or privacy concerns can be sent through the DwellPact support page or to dwellpact@gmail.com.
